The Lifting Operations and Lifting Equipment Regulations 1998 require that all patient hoists in care homes are thoroughly examined at least every six months by a competent person -- and this is distinct from routine servicing.
Why this matters
CQC inspectors regularly request LOLER examination reports as evidence of the Safe domain. A hoist used without a current thorough examination is both a regulatory breach and a direct risk to residents.
What to do
- 1Schedule thorough examinations for all lifting equipment -- ceiling hoists, mobile hoists, bath hoists and slings -- at least every six months.
- 2Ensure examinations are carried out by a competent independent engineer, not an internal maintenance operative.
- 3Keep examination reports for at least two years and make them accessible for CQC inspection.
- 4If a defect report identifies a risk of serious personal injury, confirm the competent person has notified HSE directly as required by LOLER.
