The Gas Safety (Installation and Use) Regulations 1998 require annual gas safety checks on all gas appliances in commercial premises, including care homes. The check must be carried out by a Gas Safe registered engineer and the certificate (CP12) retained for at least two years.
Why this matters
A lapsed gas safety certificate is a criminal offence under the Gas Safety Regulations, not merely a compliance gap. If a gas-related incident occurs at premises with a lapsed certificate, the operator faces both criminal prosecution and civil liability with no mitigating evidence.
What to do
- 1Ensure gas safety checks are diaried 30 days before the current certificate expires not on the expiry date.
- 2Confirm your engineer is Gas Safe registered and that the registration covers the type of appliances on your site.
- 3Retain all CP12 certificates for a minimum of two years include them in your CQC evidence pack.
