L8 distinguishes between the 'duty holder' (the employer or person in control of the premises -- typically the registered provider) and the 'responsible person' (RP) who is appointed to manage Legionella control day to day. The RP must be competent -- which means having sufficient authority, knowledge, training and resources to implement the written scheme and respond to issues.
The RP does not need to carry out the technical monitoring themselves, but must understand the system, the risks, the control measures, and the limits of their own knowledge. Relevant training includes the Legionella Control Association's Responsible Persons training, IOSH Managing Safely with a Legionella module, or a BOHS W001/W002 award.
The RP is accountable for ensuring the written scheme is followed, all monitoring is recorded, contractors are supervised and their work verified, and any out-of-range results are acted upon promptly. If a resident contracts Legionnaires' disease and the water system is implicated, the RP and the duty holder face personal and corporate liability.
