L8 requires a 'responsible person' (RP) to be appointed with overall accountability for Legionella control. In a care home, this is typically the registered manager or facilities manager. The RP must understand the water system, ensure the risk assessment is current, ensure control measures are implemented and monitored, and ensure all relevant staff are trained.
The RP must produce (or commission) a written scheme for the control of Legionella risk. This is the operational counterpart to the risk assessment -- it documents exactly what control measures are in place, who is responsible for each, at what frequency, and what to do if a result is out of range. It is the day-to-day compliance document and must be kept up to date.
All monitoring results must be recorded with the date, location, person carrying out the check, and result. This includes temperature monitoring, sentinel outlet flushing, disinfection records, and any water sampling results. Records must be retained for a minimum of five years.
