A "dead leg" is a section of pipework that is no longer in active use but remains connected to the water system, creating a zone of stagnant water at ideal Legionella proliferation temperatures. HSE HSG274 requires all dead legs to be identified in the water risk assessment and either removed or capped.
A dead leg is a section of pipework still connected to the live water system but no longer serving an active outlet -- for example, pipework left behind after a sink or shower was removed, or a branch feeding a room that has been converted to another use. Because water in a dead leg is not regularly drawn through, it sits stagnant at temperatures that often fall within the range most favourable to Legionella proliferation, roughly 20C to 45C, making dead legs a disproportionately high risk relative to their small physical size.
Care home buildings are frequently reconfigured over their lifetime -- bedrooms converted from other room types, en-suites added, equipment such as old sluice rooms or laundry facilities removed or relocated. Each of these changes can leave behind pipework that was never properly capped back at the main run, and because dead legs are hidden within walls or risers, they are often not noticed unless someone is specifically looking for them during a water risk assessment survey.
HSE HSG274 Part 2 requires all dead legs identified during the water risk assessment survey to be recorded, evaluated for risk, and either removed by capping back to the nearest live point in the system or, where removal is not immediately practicable, included in a documented interim flushing regime until permanent remedial work can be carried out. Simply noting a dead leg's existence without a remediation plan does not meet the requirement.
A thorough water risk assessment survey should trace the system methodically, comparing as-built or as-fitted drawings against the current layout, and physically checking for capped stubs, redundant valves and outlets that no longer function. Where drawings are missing or unreliable, which is common in older care homes, a physical trace-out by a competent assessor is the only reliable method, and any uncertainty should be flagged rather than assumed to be low risk.
An HSE inspector who identifies a known, un-remediated dead leg during an inspection -- particularly one that was flagged in a previous water risk assessment but never actioned -- treats this as clear evidence that identified risks are not being controlled, which is grounds for enforcement action such as an Improvement Notice. Prompt capping of dead legs, ideally at the time they are created during any building works, is far cheaper and lower-risk than remediating a legacy problem discovered years later.
